The lawyers for the main opposition United National Party (UNP) withdrew the Presidential Election petition filed in the Supreme Court challenging the election of President Chandrika Bandaranaike Kumaratunga as Sri Lanka's fourth Executive President on December 21, 1999. The five-judge Bench of the Supreme Court dismissed the petition on Monday Feb 12th, without costs after President's Counsel Tilak Marapana appearing for UNP Deputy Leader Gamini Atukorale informed court that his client did not wish to proceed with the petition. The Bench comprised, the Chief Justice, Sarath N. Silva, Justice S. W. B. Wadugodapitiya, Justice P. R. P. Perera, Justice Dr. Shirani Bandaranayake and Justice D. P. S. Gunasekera. Mr. Marapana said that having considered the contents of the preliminary order and the feasibility of proceeding with the case, the petitioner had advised him not to adduce any evidence in support of the petition and that in the circumstances the trial would conclude on Monday. "The order of the Supreme Court has materially changed the character of my petition and the burden placed on me and I have in this context been advised not to proceed with the inquiry", Gamini Athukorale, MP, Deputy Leader of the UNP said in a statement.
