Expulsion of UNP rebels violates natural justice, says counsel
[27 Jan 2000]

The Supreme Court was told yesterday by Mr. E.D. Wickremanayake, a senior counsel, that it was a violation of natural justice, to expel, from the membership of the UNP, without calling for explanation from the member, under consideration, political sources revealed.

Mr. Wickremanayake, senior counsel for the four dissidents UNPers who challenged their expulsion from the UNP.

The petitioners stated their expulsion was null and void because according to the party constitution no explanation was called for from them and no charge sheet was served on them. Also there had not been any inquiry held against them. Only a letter from the General Secretary had informed them of their expulsion from the UNP by the Working Committee of the UNP.

Senior counsel Mr. Wickremanayake said that the dissidents had advocated the concept of a national government especially in regard to the resolution of the ethnic conflict.

However, the UNP lawyers told the court that the UNP MPs were expelled not because they advocated a national government but supporting President Kumaratunga at the Presidential elections.

Further submissions would be continued today.
