A notice was ordered to be issued yesterday on five respondents including National Unity Alliance, Secretary, with regard to the petition filed before the Court of Appeal by a TELO candidate against NUA for the electoral district of Batticaloa. Justice J A N De Silva called the NUA to submit the original nomination paper and directed other relevant authorities to produce particular documents relevant to the petition. The petitioner N. Inderkumar met the Elections Commissioner, Returning officer of the Batticaloa Electoral District, NUA Secretary and seven other NUA candidates. The petitioner strongly stated that when he checked the copy of the nomination paper of NUA, the name of Chelliah Rajaduarai’s name was written as the 4th respondent. The above mentioned person, who was a former High Commissioner to Malaysia and presently residing in Malaysia was not available in Colombo on 3 September. The petitioner also stated that the gathered groups at Kachcheri also have conveyed a negative answer to the question of his presence at the Kachcheri on the nominations day. He further added that the 4th respondent’s name was not lawfully attested by a justice of peace due to the reason of his unavailability in Sri Lanka. He strongly said, as Chelliah Rajadurai’s name was in non-of the Electoral Registers of Voters in any part of Sri Lanka, his name must be rejected. The petitioner also stated as the 10th respondent or the 7th candidate of the NUA, S. Aileswaran is presently being detained by the Kandy Police, no documentary evidence was placed before the returning officer to prove his signature. The petitioner strongly remains in the conclusion that as the 4th and the 10threspondent of the NUA is not proper and lawful, due to their respective signatures were forged. Therefore NUA fails to contain required number of candidates as allotted in the section 15 (I) of the act. Finally the petitioner appealed the Court to issue a mandate in the nature of a writ of Madamus directing the respective authorities to treat the nomination paper as null and void.
