Presidential powers usurped?

Chief Justice Sarath N. Silva on Monday, October 27, appointed a panel of five Supreme Court judges, including himself, to hear President Chandrika Kumaratunga’s application to determine whether the Defence Minister had encroached the powers vested with the Executive Presidency of the country, under Section 129 of the Constitution.

Defence Minister Tilak Marapane issued a gazette notification in regard to the extensions of service to military officers two weeks ago. The President, filed an application to the Supreme Court seeking a determination whether gazette notifications issued by the Minister concerning extensions is valid in law.  

In the application it was mentioned that according to the constitution of Sri Lanka such powers are vested in the Head of the State who is the commander- in- chief of the force.

The panel of judges is expected to meet October 31st to conduct an extensive inquiry into the matter.
