Court rules: President’s fundamental rights violated [March 28, 2006 - 10.00 GMT]

The Supreme Court yesterday ruled that President Mahinda Rajapaksa’s fundamental rights were violated while he was Prime Minister and presidential candidate, by the CID probe on the Helping Hambantota controversy relating to tsunami funds.

It ordered the Police Chief Chandra Fernando, DIG in charge of the investigation Lionel Gunatilake, and the complainant MP Kabir Hashim to personally pay President Rajapaksa Rs. 100, 000 each as damages, while the state will pay Rs. 200, 000 as costs.

The Court declared that the CID investigation had violated Mr. Mahinda Rajapaksa’s fundamental rights at a time he was campaigning for the Presidency. 

The Bench headed by Chief Justice Sarath N. Silva and including Justices Shiranee Tilakawardane and Nimal E. Dissanayake said the complaint made by MP Kabir Hashim was not supported by evidence and the criminal investigation was unlawful.
