No referendum needed – Supreme Court

 

Speaker of Parliament Hon. Chamal Rajapaksa informed Parliament today (September 07) that the Supreme Court has determined that the Constitutional Reforms Bill does not require a referendum in order to be passed. It will only require a 2/3 majority in Parliament.

The 18th Amendment will be presented to Parliament by Prime Minister D.M. Jayaratne tomorrow for debate and it will be taken for vote at the end of day’s proceedings.

The proposed constitutional amendment includes provision for removal of the restriction on the term of office of the presidency, and amends the 17th Amendment to facilitate the constitution of a Parliamentary Council in its place. It was approved by the Cabinet of ministers on 2nd of this month and was immediately refereed to Supreme Court for its determination as an Urgent Bill.

According to Article 122 of the Constitution the Supreme Court will have to communicate its determination to President and the Speaker of the House within 24 hours, citing as to whether the provisions of the amendments are consistent with the Constitution.
